Even if your lease or sublease addresses the terms of a security deposit, some states require a separate written receipt to be provided to the tenant or subtenant. In states that do not require a receipt of this type, using this form is still good practice as it provides a record of the transaction and protects both parties.

In states where you are required to hold the security deposit in a separate bank account, it also satisfies the requirement to inform the tenant or subtenant of where the deposit is held.

Laws applying to landlords also apply to sublandlords, so this form should be used by anyone collecting security deposits or last month's rent for either a lease or a sublease.

If you're using this form as part of an extension agreement, we assume you complied with any applicable requirements for the security deposit/prepaid rent when the original lease was signed.
