Notice to Terminate a Month-to-Month Tenancy (IL)

A month-to-month tenancy (also known as a tenancy at will) is an arrangement between a landlord and tenant where the tenancy continues each month until either one gives notice to the other to cancel. The tenancy could have been month-to-month from when the tenants began living in the property, or it could have changed into a month-to-month tenancy under the terms of a lease agreement after the fixed term lease came to an end.

This document will produce the required notice for a landlord to inform their tenant that the month-to-month tenancy is being terminated and that they will have to move out of the rental property. It can be used whether or not there is a written agreement in place.

Note that this document is not a notice of lease termination for the tenant's failure to pay rent and should not be used if you think that legal action will be required to remove the tenant, or if the termination date has already passed and the tenant has not left the rental property. You should consider consulting an attorney in this instance as most states have very specific requirements on how to proceed.
