Governmental immunity does not extend to federal agents engaging in illegal searches and seizures. For example, the individual harmed as the result of an illegal search can sue the Alcohol, Tobacco and Firearms agents for money damages in a civil lawsuit if they entered his or her home without a warrant and used unreasonable force in a subsequent arrest. Additionally, law enforcement agents may be sued for:
- assault
- battery
- false imprisonment
- false arrests
- abuse of process
- malicious prosecution
